1. Agreement to Terms

By booking an appointment, purchasing services, or using the facilities at My Beauty Secrets VIP Medical Spa ("we," "us," or "our"), you ("client" or "you") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not book or use our services.

2. Services Provided

My Beauty Secrets VIP Medical Spa offers the following medical aesthetic services:

  • Hydra Organic Facials

  • Microneedling

  • Chemical Peels

  • Body Sculpting (EMS Technology)

  • Cavitation

  • Fat Freezing (Cryolipolysis)

  • Laser Hair Removal

  • Other aesthetic treatments as advertised

3. Appointment Booking and Confirmation

3.1 Booking Process

Appointments can be booked through our website, phone, or in person. All appointments are subject to availability and confirmation by our staff.

3.2 Consultation Required

Certain treatments require an initial consultation to determine suitability. We reserve the right to refuse service if we determine a treatment is not appropriate for you.

4. Cancellation and No-Show Policy

4.1 Cancellation Notice

We require at least 24 hours' notice for cancellations or rescheduling. Failure to provide adequate notice may result in a cancellation fee of 50$ (non-refundable deposit).

4.2 No-Show Policy

Clients who fail to show up for a scheduled appointment without prior notice will be charged 100% of the scheduled service cost. No refunds, credits, or rescheduling will be provided for no-show appointments.

4.3 Late Arrivals

Clients arriving more than 15 minutes late may need to reschedule their appointment. The full treatment time cannot be guaranteed for late arrivals.

5. Payment Terms

5.1 Payment Methods

We accept cash, debit, and major credit cards. Payment is due at the time of service unless other arrangements have been made in advance.

5.2 Package Purchases

Treatment packages must be paid in full at the time of purchase. Packages are valid for 12 months from the date of purchase unless otherwise specified.

5.3 Prices

All prices are in Canadian dollars (CAD) and are subject to change without notice. Applicable taxes will be added to all services.

6. Refund and Exchange Policy

6.1 Service Refunds

Due to the personalized nature of our services, refunds are generally not provided once a service has been performed. If you are unsatisfied with a service, please contact us within 48 hours so we can address your concerns.

6.2 Package Refunds

Unused portions of treatment packages are non-refundable but may be transferred to another person as a gift.

6.3 Product Returns

Unopened products may be returned within 14 days of purchase for a full refund. Opened products cannot be returned due to health and safety regulations.

7. Client Health and Safety

7.1 Medical History Disclosure

Clients must complete an accurate health history form prior to treatment and disclose all relevant medical conditions, medications, allergies, and previous treatments. Failure to disclose pertinent information may result in treatment complications for which we cannot be held liable.

7.2 Contraindications

Certain services have specific contraindications. Clients with the following conditions should not receive certain treatments without physician approval:

  • Pregnancy or breastfeeding

  • Active skin infections or open wounds

  • Recent surgery in the treatment area

  • Pacemakers or metal implants (for certain treatments)

  • Uncontrolled high blood pressure

  • Cancer or undergoing cancer treatment

  • Epilepsy or seizure disorders

  • Blood clotting disorders

7.3 Consent

By proceeding with treatment, you acknowledge that you have been informed of the treatment procedure, potential risks, and expected results, and you consent to receive the treatment.

8. Treatment Results and Expectations

8.1 No Guaranteed Results

While we strive for optimal results, individual results may vary. We do not guarantee specific outcomes as results depend on many factors including skin type, lifestyle, adherence to aftercare instructions, and individual physiology.

8.2 Multiple Sessions

Many treatments require multiple sessions to achieve desired results. The number of sessions needed varies by individual and treatment type.

8.3 Realistic Expectations

Clients are expected to maintain realistic expectations about treatment outcomes. Our staff will provide honest assessments during consultations.

9. Aftercare and Client Responsibilities

9.1 Aftercare Instructions

Clients must follow all aftercare instructions provided by our staff. Failure to follow aftercare guidelines may result in complications or suboptimal results.

9.2 Adverse Reactions

If you experience any unexpected side effects or adverse reactions after treatment, contact us immediately. While rare, complications can occur with any aesthetic treatment.

9.3 Sun Protection

Many treatments require strict sun protection and avoidance of sun exposure for specified periods. Failure to protect treated areas may result in pigmentation issues.

10. Limitation of Liability

To the fullest extent permitted by law, My Beauty Secrets VIP Medical Spa, its owners, employees, and contractors shall not be liable for:

  • Any injury, loss, or damage arising from treatments where client information was inaccurate or incomplete

  • Complications arising from failure to follow aftercare instructions

  • Results that differ from client expectations

  • Allergic reactions to products used (unless known allergens were disclosed)

  • Indirect, incidental, special, or consequential damages

Our total liability shall not exceed the amount paid for the specific service in question.

11. Privacy and Confidentiality

11.1 Personal Information

We collect and store personal information as necessary to provide services. We are committed to protecting your privacy in accordance with Canadian privacy laws (PIPEDA).

11.2 Use of Information

Your personal information may be used to:

  • Provide and improve our services

  • Send appointment reminders and promotional offers (with consent)

  • Process payments

  • Comply with legal requirements

11.3 Marketing Communications

By providing your contact information, you consent to receive promotional communications from us. You may opt out at any time by contacting us or using the unsubscribe link in emails.

11.4 Before and After Photos

We may request permission to take before and after photos for your treatment records and potentially for marketing purposes. Separate written consent will be obtained before using any photos publicly.

12. SMS Marketing Program

12.1 Description of SMS Use Cases

By subscribing to our SMS marketing program, you agree to receive recurring automated marketing text messages from My Beauty Secrets VIP Medical Spa at the phone number provided. Message frequency varies depending on your preferences and our promotional activities. Messages may include:

  • Appointment reminders and confirmations

  • Promotional offers and special discounts

  • New service and product announcements

  • Beauty tips and skincare advice

  • Exclusive subscriber-only deals

  • Updates about our spa services and hours

  • Seasonal promotions and special events

  • Last-minute appointment availability

12.2 Opt-Out Instructions

You can cancel the SMS service at any time. Simply text STOP to any mobile message you receive from us. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

12.4 Message and Data Rate Disclosure

Message and data rates may apply for any messages sent to you from us and to us from you. The number of messages you receive will vary depending on your interaction with our services and current promotions. You may receive approximately 2-10 messages per month, but this may vary.

If you have any questions about your text plan or data plan, please contact your wireless provider. Standard messaging and data rates from your mobile carrier will apply.

12.5 Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages. We are not responsible for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an "AS IS" basis, and we make no warranties regarding the timeliness or successful delivery of messages.

Compatible carriers include but are not limited to: AT&T, T-Mobile, Verizon Wireless, Sprint, Rogers, Bell, Telus, and other major Canadian and US carriers. Service may not be available on all carriers.

12.6 Age Restriction (18+)

You must be 18 years of age or older to subscribe to our SMS marketing program. By subscribing, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement.

12.8 Consent to Receive SMS Messages

By providing your mobile phone number and opting in to our SMS program, you expressly consent to receive automated marketing text messages from My Beauty Secrets VIP Medical Spa. Consent is not a condition of purchase or receiving services. You may still book appointments and use our services without subscribing to SMS messages.

13. Minors

Clients under 19 years of age must be accompanied by a parent or legal guardian who must sign consent forms on their behalf. Certain treatments are not available for clients under 19.

14. Gift Certificates and Promotions

14.1 Gift Certificates

Gift certificates are valid for 12 months from the date of purchase and are non-refundable. Gift certificates cannot be redeemed for cash.

14.2 Promotional Offers

Promotional offers cannot be combined with other offers unless explicitly stated. Promotions are subject to availability and may be modified or discontinued at any time.

15. Professional Conduct

15.1 Respectful Environment

We are committed to providing a respectful, professional environment. Inappropriate behavior, harassment, or abuse toward staff will not be tolerated and may result in immediate termination of services without refund.

15.2 Right to Refuse Service

We reserve the right to refuse service to any client for any reason, including but not limited to:

  • Failure to provide accurate health information

  • Being under the influence of drugs or alcohol

  • Inappropriate behavior

  • Medical contraindications

  • Non-payment or history of payment issues

16. Intellectual Property

All content on our website, marketing materials, and treatment protocols are the intellectual property of My Beauty Secrets VIP Medical Spa and are protected by copyright laws. Unauthorized use or reproduction is prohibited.

17. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of any changes.

These terms apply to services provided at all My Beauty Secrets VIP Medical Spa locations:

19. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of British Columbia, Canada. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms and Conditions, together with any consent forms and treatment agreements you sign, constitute the entire agreement between you and My Beauty Secrets VIP Medical Spa regarding the provision of services.
